A altera\u00e7\u00e3o foi realizada durante a gest\u00e3o do ex-prefeito Jairo Jorge (PDT). Conforme a decis\u00e3o, originalmente os servidores foram nomeados, ap\u00f3s aprova\u00e7\u00e3o em concurso, para um cargo que tinha como requisito de escolaridade o 1\u00ba grau completo. No entanto, posteriormente, foi editada a Lei Municipal n\u00ba 5.581\/2011, a qual exige para Agente de Apoio \u00e0 Educa\u00e7\u00e3o Infantil, o n\u00edvel m\u00e9dio, modalidade normal\/magist\u00e9rio.<\/p>\n<p>Al\u00e9m disso, a nova legisla\u00e7\u00e3o traz altera\u00e7\u00e3o tanto em rela\u00e7\u00e3o \u00e0 denomina\u00e7\u00e3o do cargo quanto ao rol de atribui\u00e7\u00f5es estabelecidas para o mesmo, sendo que o cargo de Agente de Apoio \u00e0 Educa\u00e7\u00e3o Infantil abarca atribui\u00e7\u00f5es muito mais complexas do que o cargo origin\u00e1rio, tais como: executar atividades de cuidado, zelo e desenvolvimento de crian\u00e7as na faixa de zero a tr\u00eas anos e onze meses, orientar a constru\u00e7\u00e3o do conhecimento, elaborar e desenvolver projetos pedag\u00f3gicos auxiliares e complementares e outros trabalhos de orienta\u00e7\u00e3o ao pleno desenvolvimento da crian\u00e7a; j\u00e1 para o cargo de Atendente de Creche, a lei anterior dispunha sobre a realiza\u00e7\u00e3o de atividades pouco complexas, como higiene, alimenta\u00e7\u00e3o, e brincadeiras.<\/p>\n<p>Em seu parecer, o conselheiro-relator Estilac Martins Rodrigues Xavier ressaltou que os exames realizados pelos \u00f3rg\u00e3os t\u00e9cnicos e pelo Minist\u00e9rio P\u00fablico de Contas consideram que os 146 ingressos oriundos de reenquadramento n\u00e3o observaram os requisitos essenciais para a legitimidade da conduta.<\/p>\n<h6>O que diz o Sinprocan<\/h6>\n<p>&#8220;Vemos isso como um erro administrativo cometido na administra\u00e7\u00e3o anterior. A atual teria que corrigir essa situa\u00e7\u00e3o. Os servidores n\u00e3o podem perder o cargo, o RH ter\u00e1 que estudar o caso para que ningu\u00e9m seja prejudicado&#8221;, afirma o presidente do Sindicato dos Profissionais em Educa\u00e7\u00e3o Municipal de Canoas (Sinprocan), J\u00falio C\u00e9sar Rodrigues.<\/p>\n<h6>O que diz a Prefeitura<\/h6>\n<p>Notificada, a atual administra\u00e7\u00e3o da Prefeitura de Canoas diz que ainda est\u00e1 discutindo juridicamente com o TCE.
