O Juiz do 2\u00b0 Juizado da 1\u00aa Vara C\u00edvel da Comarca de Canoas, Geraldo Anast\u00e1cio Brandeburski J\u00fanior, determinou, nesta quarta-feira, 21, que a Prefeitura de Canoas indenize, por danos morais e materiais, donos de resid\u00eancias que tiveram suas casas alagadas em diversas ocasi\u00f5es entre os anos de 2015 a 2017. O Munic\u00edpio de Canoas, por sua vez, alegou que, embora os alagamentos tenham sido ocorridos desde 2015, os autores somente notificaram a Administra\u00e7\u00e3o em abril de 2017, data em que foi providenciada a instala\u00e7\u00e3o de tubos de 1 metro de di\u00e2metro na extens\u00e3o de 230 metros. <\/p>\n

Senten\u00e7a <\/strong>
\nSegundo o magistrado, o problema dos alagamentos na regi\u00e3o da resid\u00eancia dos autores n\u00e3o \u00e9 fato novo e imprevis\u00edvel. E afirmou que a ocorr\u00eancia das inunda\u00e7\u00f5es \u00e9 induvidosa: \u201cal\u00e9m de a parte r\u00e9 n\u00e3o ter negado a ocorr\u00eancia, os fatos est\u00e3o demonstrados em fotos e documento\u201d. \u201cEntendo que os alagamentos tiveram como causa suficiente o Poder P\u00fablico Municipal, ao n\u00e3o realizar obras para a canaliza\u00e7\u00e3o e evas\u00e3o das \u00e1guas. O Munic\u00edpio passa a ser respons\u00e1vel quando, tendo condi\u00e7\u00f5es de prestar um servi\u00e7o, n\u00e3o o faz\u201d, concluiu o Juiz\u201d. <\/p>\n

Indeniza\u00e7\u00e3o <\/strong>
\nCom rela\u00e7\u00e3o aos danos, fixou indeniza\u00e7\u00e3o de R$ R$ 23.106,86 para os materiais, e R$ 3 mil, pelo abalo moral, para cada um dos tr\u00eas autores. <\/p>\n","protected":false},"excerpt":{"rendered":"
